Blue Web Host Terms and Conditions
The following
policies have been designed to protect the interest of our customers.
All customers must agree to the following:
1) Account Setup
We will setup your account after we have received payment and we have screened
the order(s) in case of fraud. It is your responsibility to provide us with an
email address which is not @ the domain(s) you are signing up under. Therefore
we can contact you in case of any problems. We may carry out random verification
checks.
2) Content
All services provided by Blue Web Host may only be used for lawful purposes.
This includes, but not limited to: copyrighted material, material we judge to be
threatening or obscene, pornography. We reserve full right
to provide your details upon request to any legal representative and authority
Examples of unacceptable material:
IRC Bots
Warez Sites
Pirated SoftwareHate sites
Hack programs and archives
3) Zero Tolerance Spam Policy
Spamming and sending unsolicited emails from our servers or
using email addresses that are maintained by us is STRICTLY prohibited and will
qualify your site for immediate deactivation with no refund. Blue Web Host
will be the decider as to what constitutes a violation of this provision and our
decision will be final.
4) Payment Information and Setup
You agree to supply appropriate payment for the services received from
Blue Web Host, in advance of the time period during which such services are
provided. You agree that until and unless you notify Blue Web Host of your
desire to cancel any or all services received, those services will be billed on
a recurring basis.
Billing:
If paying by a cheque, please allow 5 days for the cheque
to clear and for us to open the account.
Setup:
Your order will undergo fraud verification checks before it is accepted into our system which includes an automatic telephone verification service..
Upon receipt of your payment - all ordered services will be setup and a notification email sent.
If you have paid the invoice and all debits have been cleared and a notification email has not been sent within 24hours, please contact our billing department (billing@bluewebhost.co.uk)
5) Backups and Data Loss
You are fully responsible for the files and the content you upload to the server
and we are not responsible for files and data residing on your account. You
agree to take full responsibility for files and data transferred and we
cannot provide daily back up thus the back up of the site must be maintained by
the customer. As a result of the amount of resources a site takes up it is in
the interest of the customer to take the back up of your site on a regular basis
in case of any unlikely server break downs.
6) Cancellation and Refunds
You are entitled to a full refund within 30 days of opening your account as long
as a valid reason is provided. If at any point after the 30 days you are unhappy
with the service and can provide a suitable explanation, we will refund you for
the remainder of your contract. Please note, Blue Web Host reserves the
right to suspend any account at any time on receipt of Abuse complaints.
If your domain came free with your account then the total
of 14 UK pounds is non refundable therefore you will be issued a refund to the
total you paid minus 14 UK pounds to cover the domain costs. Incase of .co.uk or any
other UK domains we will deduct £18 from the total refund. We reserve the right
to refuse refunds if your reason is deemed not acceptable by our management. We
are unable to offer refunds on our Site-builder software at present.
7) Resource Usage
Users may not initiate the following:
a) Use 25% or more of system resources for longer then 90 seconds. There are
numerous activities that could cause such problems; these include: CGI scripts,
FTP, PHP, HTTP, etc.
b) Run stand-alone, unattended server-side processes at any point in time on the
server. This includes any and all daemons, such as IRCD.
c) Run any software that interfaces with an IRC (Internet Relay Chat) network.
d) Run any gaming servers such as counter-strike, half-life, battlefield1492,
etc
8) Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending
on the hosting package you purchase. If the customers
account exceeds the bandwidth limit, we shall let the customer know. If the
customer does not wish to purchase extra bandwidth or upgrade his account and
continues to exceed their limit, the account shall be suspended until the
customer takes measures to ensure that the limit will not exceed again. The
account will be reactivated in the following month once the bandwidth has been
reset.
10) Price Change
The amount you pay for hosting will never increase from the date of purchase,
until your existing contract expires. We
reserve the right to change the prices of our services, and the right to
increase the amount of resources given to plans at any time.
11) Indemnification
Customer agrees that it shall defend, indemnify, save and hold Blue Web Host
harmless from any and all demands, liabilities, losses, costs and claims
12) Disclaimer
Blue Web Host will not be responsible for any damages your business may
suffer. Blue Web Host makes no warranties of any kind, expressed or implied
for services we provide. Blue Web Host disclaims any warranty or
merchantability or fitness for a particular purpose. This includes loss of data
resulting from delays, no deliveries, wrong delivery, and any and all service
interruptions caused by Blue Web Host and its employees.
13) Closure of Service:
In the event that Blue Web Host has to ever close down, the customer will receive a refund for the remainder of the contract that they hold with Blue Web Host and we will offer you a similar cost solution with another UK web hosting provider and transfer your account across. Alternatively, we will close your account so you can find another Web hosting provider yourself. We reserve the right to close at anytime but must give 2 months notice.
13) Refusal of Service:
We reserve the right to refuse, cancel, or suspend service
at our sole discretion.
These terms may be modified at any time and without notice.
All users previous and new are always subject to the newest terms posted here at
all times.
Blue Web Host reserves the right to revise its policies at any time without notice. However, customers will be informed of any changes made.
